CANCELLATION AND REFUND CONDITIONS

 

1- PARTIES

On the one hand, YeÅŸilbahçe Mah. Çınarlı Cad. M.K. Laledi Touristic International Travel Agency (hereinafter referred to as AGENCY) located at AyanoÄŸlu Sitesi No 42/2 MuratpaÅŸa Antalya Turkey, and on the other hand, persons residing at ...... and those who will benefit from the tour / service (hereinafter referred to as AGENCY) (referred to as the Customer) have reached a full agreement on the matters set out below. In matters not written in this contract, Law No. 1618 and the Regulations, Statutes and Circulars, Communiqués and Schedules issued accordingly, 2634 S.K., IATA, IHA, UFTAA Convention Provisions and international private and official agreements will apply.

A - At least 35% of the total tour service fee must be paid at the time of registration, and the balance must be paid 15 days before the start of the tour. If the specified payments are not made within the mentioned periods, the reservation will be canceled and 35% of the total service fee will be billed to the consumer as cancellation compensation.

B – The consumer who purchases Promotional, Discounted, Special Product services is obliged to pay the entire service fee on the reservation date. For special products and services, the balance must be paid at least 60 days before the start of the service. Withdrawal compensation is the same as in Article 1/A.

 

2- CANCELLATION AND REFUND

A - Although the agency has shown all necessary care, it prevents the start or continuation of the trip; may cancel or postpone the trip due to the fact that the final records do not reach the required number of passengers and/or adverse weather conditions, road obstacles, strikes, terrorism, fog, possibility of war, unforeseen technical issues and all these and similar force majeure reasons. In this case, the consumer has no right to compensation.

B - When the consumer requests cancellation up to 1 month before the start of the service for weekly package tours and excursions, the entire amount paid will be refunded to him/her. For daily tours, the full price paid up to 24 hours before the start of the trip will be refunded, based on the local time zone. The Consumer agrees and undertakes to pay 50% of the trip fee to the Agency if he/she cancels the contract 20-15 days before the start of the weekly accommodation package tour service, and the whole amount if less than 15 days before. Date changes made by the consumer have the effect of cancellation.

C- For promotional/discounted products, the consumer does not have the right to cancel or change the product he/she has purchased.

D- For special products, in case of cancellations made up to 60 days before the start of the service, the consumer will be refunded the entire fee paid up to that point. If the consumer cancels the contract 59-31 days before the start of the trip, 25% of the trip cost; if the consumer cancels the contract 30-15 days before, 50% of the trip cost; if he cancels the contract 14-07 days before, 75% of the trip cost. If the deadline is less than 7 days, the person agrees and undertakes to pay the entire amount to the Agency.

E- The amount paid by the consumer for the service will be refunded to the consumer, provided that he or his first-degree relatives are documented with an official report obtained from a full-fledged state hospital or in case of death, for the 10-day period of the tour period, which prevents them from doing their usual activities. In this case, the report and documents will be submitted before the start of the service. If this situation occurs during the continuation of the tour service, the excuse must be submitted to the Agency together with the document within 1 day from the date of departure of the Consumer from the tour.

F- Up to a maximum of 7 days after the reservation date, the Consumer can cancel the tour service received or transfer it to the person or persons he/she wishes, provided that it complies with the same reservation type. However, early booking discounted products cannot be transferred to other people. The transferee is responsible together with the transferor for the balance and all expenses arising from the transfer. The consumer is obliged to submit all cancellation/transfer requests to his agency in writing within the period specified above. This article is not valid if the service received is a product within the scope of the campaign and/or if there is less than 7 days between the reservation and the start of the service.

G- If the consumer does not notify in writing that he will participate in the service whose start he missed; The Agency has the right to cancel all reservations and services made on behalf of the Consumer within 24 hours from the start date of the service. In such cancellations, no refund will be made to the Consumer.

H- If deemed necessary, the Agency may cancel the tours it has announced or registered for, partially or completely, before the start of the service, provided that it notifies the Consumer. During the same period or during the service, the agency may change the names of the hotels within the scope of the service, the means of transportation and their departure locations, and the order of visits of the places specified in the program and shown as places to visit. If the consumer does not accept these changes and cancellations for justified reasons, he has the right to cancel his reservation and receive a refund of unconsumed service fees.

 

3- GENERAL PROVISIONS

A- All responsibility for the luggage and its contents belongs to the owner. The consumer is obliged to comply with the legislation and practices governing the vehicle in which he will travel and the facility in which he will stay.

B- In cases of baggage loss or damage caused by the fault of the provider; If the consumer has a Loss or Damage REPORT prepared by the provider, ½ of the part of the total service fee corresponding to transportation, regardless of the material and moral value of the items in the luggage and their other qualities and characteristics, is paid to the consumer by the Agency as material and moral compensation for the lost items and luggage. The agency is responsible for any loss, damage or theft of the goods received after their value has been declared to it in writing, up to a maximum of the transportation cost of the tour.

C- VISA PROCEDURES and SERVICES are not included in the service purchased. The customer who declares that he/she has a visa for the countries of the tour in which they will participate or who declares that he/she will follow the visa procedures personally cannot terminate the contract by claiming that the visa procedures have been completed. The responsibility belongs to the customer.

D- The Agency is not responsible for force majeure events that occur after the start of the service subject to the contract, situations arising from the Consumer and personal responsibilities of third parties. In cases within its responsibility, the Consumer may compensate for the changes against the Consumer in the form of a fee or service refund in accordance with the provisions of the TÜRSAB Kütahya Schedule, or may also seek compensation through additional and/or alternative arrangements that are not included in the price and given to the Consumer during the service. The fact that additional or substitute services are purchased, used or consumed by the Consumer eliminates the Consumer's rights to refund and compensation.

E- Consumer; He accepts that he will comply with the rules declared by the guide, facility, agency, transportation vehicle officials and the insurance company regarding the purchased service, and that he will respect the life, property safety and peace of third parties, otherwise he will not be able to receive the service for a justified reason and he does not have the right to return the service.

F- If the consumer terminates the service received due to defective service, he/she must notify the Agency representative and the hotel he/she is staying in in writing about the reasons for termination. Otherwise, he is deemed to have received and used the service.

G- It is the obligation of the well-intentioned consumer to cooperate and act diligently to notify the Agency in writing about the issues the consumer complains about during the performance of the service.

H- Consumer(s) who do not have a signature on the contract but participate in the service subject to the contract are deemed to have accepted and undertaken the provisions of the contract when the consumers they have assigned to register on their behalf read and sign this Agreement. The Agency reserves the right to appeal to other consumers for the collection of the excess amount or service fee paid to the consumer(s) who signed the contract.

I- When entering a foreign country, the authority to grant entry permission belongs to the passport police of that country and may not grant permission to enter the country, regardless of whether there is a visa or not, without showing any valid reason. The agency cannot be held responsible for this situation.

J- If the package tour service is purchased, the cases where the package tour is incomplete or not performed at all are covered by insurance in accordance with the law. Coverage is limited to the package tour price.

K- If the consumer wishes, he/she can insure the expenses of returning to the starting point in case of accident or illness, damage arising from any accident and treatment expenses before the package tour service starts.

L- In cases where the Agency does not fully or partially comply with the Agreement, TÜRSAB KÜTAHYA SCHEDULE articles are applied in calculating the compensation to be paid.
